Terms and Conditions
Offer and sale of products on www.proeon.it web site are ruled by the conditions listed below. The confirmation of the order by the customer constitutes acceptance of these sale conditions.
Purchase conditions
Before forwarding the purchase order, the customer is required to read all the terms. The placing of the order implies its automatic acceptance. The customer buys the product, whose characteristics are described online in the data sheet, and at the indicated price in addition to the shipping charges as shown on the website.
Before confirming the purchase order, in the website the customer has to read and check the unitary cost of each selected product, the total cost when he purchases more products, the cost of additional costs depending on the selected type of payment and the cost of postage. Once confirmed the purchase order, the customer will receive an e-mail with the confirming receipt and acceptance of the order. By sending the mail confirming the purchase, the contract is concluded and formalized. Proeon® reserves the right not to accept or process orders that are incomplete or missing core data.
Timing and delivery modalities
Proeon® is responsible for delivering the products selected and ordered by the customer in the manner referred to in the previous article by Poste Italiane. Delivery, in accordance with art. 6 of Legislative Decree. N. 206/2005, takes an average of 3 days and not exceeding 30 days from the day following the date of the order. The invoice will be issued to the customer in the package sent, using the data entered by the customer during the registration in the website. We advise you to enter your tax code or VAT for this reason.
Prices and products details
All the selling prices of the products on the website are in euros and include VAT and all other Italian taxes. Any promotions are to be considered valid only for the online store and for the selected period of time. The prices charged are those shown on the website at the time of the purchase by the customer. From time to time a change in the products prices is possible and the prices of products published always cancel and replace the previous ones. Product images are for illustration purposes only.
Payment method
Bank transfer: the customer can make the transfer on Proeon® account. The bank details are presented in the purchase page. The goods will be shipped after the receipt of the transfer by Proeon®. In the bank transfer in order to speed up the tracing of the payment and order fulfillment, please indicate your order number which has been notified by e-mail. Please send the transfer within 3 days from the order or the order will be cancelled. There is no charge for the bank transfer.
Paypal: the customer can make the payment through Paypal circuit, using a personal Paypal account, or by choosing not to register to Paypal service. In the event that payment is not made within two days of the order date the order will be canceled without notice, unless otherwise agreed between the customer and Proeon®. With Paypal you can also pay by credit cards Visa and MasterCard. There is no charge for this payment as well.
Transport
The goods travel at buyer’s request and risk. Proeon® shall not be liable for any delay or damage caused by transport. In the event that the package arrives visibly damaged, pick up the package signing with reservation; otherwise you cannot request a refund. In the event of a refusal of the package, Proeon® may require the customer the full amount of the shipping costs and the cost incurred for the return to sender of the package. The delivery times indicated by Proeon® refer to products in stock and are intended not binding since the same delivery times may be amended by Proeon® in case of actual needs.
Proeon® reserves the right to make delivery of products related to the same order in multiple deliveries at no additional charge to the customer. Special conditions and terms of delivery details will be agreed in advance through e-mail or through telephone between the customer and Proeon® and accepted by both sides. Any special offer or promotion offered by Proeon® are valid until expiration time or until stockout of the promoted products.
Shipments
For shipments to Italy, Proeon® requires a contribution of € 5.00 including VAT for orders up to € 60,00 (maximum weight of 2 kg). From 60,01 € onwards there are no shipping charges for the buyer. Shipping is intended in the Italian territory and it is valid only for purchases in Italy. For shipments to Europe of Proeon® products costs are: 20 EUR including VAT, For shipments to rest of the world of Proeon® products costs are: 35 EUR including VAT, the contribution is applied regardless of the order amount.
Product warranties
Proeon® guarantees only the physical integrity of the products upon delivery. Any defects must be reported by the customer no later than 10 (ten) days from the delivery date otherwise the order will be revoked.
The customer has the right to replace the damaged products upon return of the same, excluding the client’s right to compensation for any damage. The postage required for the replacement of products shall be payable by the customer. Proeon® does not include any additional product warranty other than that one provided by individual producers. Without prejudice to the case of fraud or gross negligence of Proeon® , it is agreed that the responsibility for Proeon® shall not exceed the price of the products purchased by the customer in dispute.
Right of withdrawal
IThe customer has the right to cancel the contract and return the ordered products within 14 (fourteen) working days from receipt of the products themselves.
The withdrawal right must be exercised by the customer by sending a registered letter with return receipt to Proeon®, Via del Tiziano, 15 – 63074 San Benedetto del Tronto (AP) – P. IVA 02171920446, within the terms provided by law, otherwise it will be revoked. The customer cannot exercise the right of withdrawal in respect of custom or bulk products. The refund will be made within 30 days from the date on which Proeon® will be informed about the exercise of the right of withdrawal by the customer, in the manner mentioned above. The customer is required within thirty (30) working days from the exercise of the right of withdrawal, to ship Proeon® products, with registered shipping and expenses are charged to the customer.

Legal notices
The general sales conditions are governed by Italian law and in particular by Legislative Decree No 206, 6 September 2005 in respect of distance contracts and by Legislative Decree No 70, 9 April 2003 on certain aspects of electronic commerce. In the event of dispute between Proeon® and each end user, arising from general conditions of sale, the place of jurisdiction is Ascoli Piceno.
Changes and updates
The general terms and conditions may be amended from time to time in consideration of possible regulatory changes. The new general conditions of sale will be effective from the date of publication on www.proeon.it.
